Additional Information on the tinker v DesMoines case
People Effected:
Students who feel they have to right to openly express their feelings in school. At the same time acknowledging the fact that they did not shed their constitutional rights. Schools can’t suspend or expel people for openly presenting their right on their person.
Majority Opinion:
"It can hardly be argued that either students or teachers shed their constitutional rights to freedom of speech or expression at the schoolhouse gate." (Justice Abe Fortas)
Basically what this means is that school authorities can't treat kids like they have lost their rights when the enter the school building.
Disenting Opinion:
The disenting opinion was that the person didn't want people, to take the fact that students don't shed their rights when they walk into school. Also for authorities to not take this case as the students control public schools. Just because there are something that aren't right acording to the first amendments as well as others. Also there were some cases in which students interrupted classes because others had questions about their armbands.
My Opinion:
I feel as though this case of suspending students was unconstitutional. Also that students according to both their first and fifth amendment rights. Are allowed to support and be against the vast majority in their feelings about certain topics. In this case the topic up for grabs is the vietnam war. The students didn't break any of the schools rules or regulations, and they expressed their opinions silently. There were also other things that lead to this which was the fact that one of the students was a victim in the casualties from the vietnam war. Another was that students from other schools agreed that if the arm band wearing caught on they would join in and were additional colors.
