Investigation Of the Korematsu V United States
The Gist of this Supreme Court case is:
When Fred Korematsu lived in Oakland california he was a nisei and american citizen. When he was 22 general DeWitt ordered everyone of japanese ancestry in the Western United states to report assembly centers. Though Korematsu was in love with someone who was of italian and american ancestry. So this lead him to make the foolish decision of not leaving his home. He then changed his name and underwent eyelid surgery to make him look less japanese. Though the government found him and arrested him for breaking the law of being japanese in an area in which anyone of japanese decent was banned.
Korematsu's problem was that the government had no evidence what so ever of his disloyalty to america.
This Case is a violation of the Fourteenth amendment Equal Protection Law: "No State shall…deny to any person within its jurisdiction the equal protection of the laws."
This Case is also a violation of the Fifth amendment Law : "No person shall..be deprived of life,liberty, or property, without due process of law"
In this case the Japanese people that were placed into internment camps and taken away from their homes, without trial or in any way a due process of law. This was a clear violation of there constitutional rights, which was the fifth amendment. What made this even more wrong was that the supreme court didn't agree to accepting the fact that they had constitutional rights because of their Japanese ancestry. Which during war was completely righteous and since there was a risk of espionage everyone had to suffer to prevent something from happening. This was also a violation of their fourteenth amendment rights because the states denied the japanese of their required equal protection law. This shows that there are many clear holes in americas choices with a war blinded lens of looking at things. Since the only thing that they are willing to look at would be unreasonable ways to ascertain absolute victory, and nothing else including the innocent homes of people mater.

In favor of agreeing that it was right to exclude citizens of japanese ancestry from certain areas. Apparently it was okay to deme a whole race "Suspect Classification" (They weren banded from their constitutional rights) since the assumed that many of them were un loyal as well as not trust worthy. They Believed that it was essential during wartime.
